Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Freeholdia ("we", "us", or "Company") governing your access to and use of the Freeholdia platform, website, and services (collectively, the "Service").

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Freeholdia is a cloud-based property management platform for independent residential landlords. The Service includes:

• Rent collection tracking and payment ledger management
• Property, unit, and tenant data management
• A tenant-facing portal for payment history and maintenance requests
• Maintenance request tracking and vendor directory
• Lease document storage and e-signature capabilities (paid plans)
• SMS notification delivery (paid plans)
• Portfolio analytics and reporting (paid plans)

To use Freeholdia you must:

• Be at least 18 years of age
• Provide a valid email address
• Maintain the accuracy of your account information
• Keep your login credentials secure and not share them with others

You are responsible for all activity that occurs under your account. Notify us immediately at support@freeholdia.com if you suspect unauthorized access.

Plan tiers

Freeholdia offers three plan tiers: Starter (free), Growth ($19/month), and Pro ($49/month). Features and unit limits vary by plan as described on our Pricing page.

Free trial

Growth and Pro plans include a 30-day free trial. No payment is required until the trial ends. You may cancel at any time during the trial period without charge.

Billing

Paid subscriptions are billed monthly in advance. Payment is processed via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Upgrades and downgrades

Upgrades take effect immediately and are prorated for the remainder of the billing period. Downgrades take effect at the end of the current billing cycle. You will retain access to higher-tier features until the end of the paid period.

Refunds

We do not offer refunds for partial months of service. If you believe you were charged in error, contact us within 30 days at billing@freeholdia.com.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You agree not to:

• Use the Service to harass, discriminate against, or engage in illegal housing practices toward tenants
• Enter false, misleading, or fraudulent information about properties, tenants, or payments
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell or sublicense access to the Service without our written permission
• Use the Service to store or transmit malicious code
• Violate any applicable fair housing, landlord-tenant, or data protection laws

We reserve the right to suspend or terminate accounts that violate these terms.

When you use Freeholdia to manage tenant information, you act as the data controller for that information. You represent and warrant that:

• You have a lawful basis to collect and process your tenants' personal data
• You will comply with all applicable privacy and data protection laws in your jurisdiction
• You will not use tenant contact information obtained through the Service to contact tenants for purposes unrelated to property management
• You will notify tenants that their information is stored and managed through Freeholdia

Our property: Freeholdia and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

Your data: You retain ownership of all data you enter into the Service (property information, tenant records, payment history, etc.). You grant us a limited license to store, process, and display this data solely to provide the Service to you.

Feedback: If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure at all times
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• Results obtained from using the Service will be accurate or reliable

Freeholdia is a software tool, not a legal or financial advisor. Nothing in the Service constitutes legal, tax, financial, or real estate advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDLORDCC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or alteration of your data
• Conduct or content of any third party on the Service
• Any other matter relating to the Service

In no event shall our total liability to you exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

You agree to defend, indemnify, and hold harmless Freeholdia and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law or regulation.

By you: You may cancel your account at any time from your account settings. Cancellation stops future billing but does not entitle you to a refund of the current period.

By us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or if we are required to do so by law. We may also terminate the Service entirely with 30 days' notice.

Effect of termination: Upon termination, your right to use the Service ceases immediately. You may export your data during the 30-day period following termination, after which it will be deleted in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall first be subject to informal resolution by contacting us at legal@freeholdia.com. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email and by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service and cancel your account.
